Difference Between Trademark Registration & Company Registration

Company and trademark are two very separate things and their registrations are a completely different affair. A trademark is an intangible asset that falls under the category of intellectual property whereas a company is a business entity that is formed by individuals to perform business activities. Trademark is a signature. Something that a business uses to get recognition. Registration of trademarks is done under Trade Marks Act, 1999. It is a slow process and takes a lot of time to get a trademark registered which can extend as much as 2 years. Trademarks are registered to promote business and gain trust of customers. Trademark registration is done for a duration of 10 years post which renewal is to be done. There is no restriction on number of renewals but every renewal is for a duration of 10 years. Trademark registration provides exclusive rights to the proprietor for use of the trademark. Getting your trademark registered is not mandatory but recommended.

Company registration

A company is an artificial person with separate legal status which is formed to run a business. If you want to form a company then its registration is compulsory. It is governed by Companies Act, 2013 which requires a lot of compliances. Incorporating a company is simple task and the centralized registration process doesn’t take much time. If all the documents are in place within 15-20 business days you’ll have Certificate of Incorporation (COI) in your hand.

A company is registered forever and does not need renewal as a trademark. A company can have any number of registered trademarks but only one trademark can be registered in the name or logo of the company. However, there is one similarity, that is, trademarks and name of companies cannot be identical or similar to an existing one.
