With the introduction of blogs and people sharing their knowledge and expertise on internet, there is a rising concern of the contents on websites and blogs getting copied. There are tools available which disable the options of copy paste but nothing can stop typing out your content and distributing it. In order to answer various questions on copyright of website & blog we have written this post. Here in this post we will discuss the what are copyrights and why should or should not obtain a copyright of website & blog.
What is copyright?
Copyright is a right given to creators of
- literary,
- dramatic,
- musical and artistic works and
- producers of cinematograph films and sound recordings.
It is a bundle of rights including, inter alia, rights of reproduction, communication to the public, adaptation and translation of the work. There could be slight variations in the composition of the rights depending on the work.
What does a website consist of from Copyright perspective?
As far as the scope of copyrighting of Website is concerned, a Website contains different material that may require copyrighting like content, images, sound recordings, videos, cinematographic films, computer application etc. Each of these is a different subject as per copyright and would require separate application under the Copyright Act in India.
Copyrighting your blog or website content?
You have a blog, you are catering to a niche, providing and sharing your experience and knowledge with people and that too publically right? Okay, the question is do you need to have copyright of this blog or website content? The answer is not simple. It could be a yes or a no depending upon your requirement.
For information purposes, let me tell you that any material you post on your website or blog is automatically copyrighted, you have written it and it is present on your blog/website. You may not need to specifically get it copyrighted with the Indian Authorities. That is why you have the “Copyright Protected 20XX” written on most of the websites as a warning.
But, getting this material copyrighted gives you a strong legal case against the copier of the material. So in case you see your content or image or video or audio etc. that was present on your website has got copied and you have already obtained a copyright for that material you get a legal edge over the copier.
Just like most of the books authors take a copyright for their material because in case this material or any part thereof gets copied or reproduced the copier either has to acknowledge the creator or face legal consequences.
Is it necessary to get the copyright of website or blog?
Okay, now since a website is a combination of content, images, videos, sounds etc. you have the choice of getting either content or images or videos or sounds through separate application.
For instance, if you want to take copyright of content you need to file an application for copyright of content. If you want copyright for content and images, you need to file two applications one for content and other for images.
Depending upon the importance of material you can file a copyright application and obtain a copyright.
